These Terms & Conditions outline the policies and expectations for portrait and headshot sessions with Ryan Martinez-Peña Photography. By booking a session, you acknowledge that you have read, understood, and agreed to the following terms.

 

1. Booking & Payment

1. All sessions must be booked via email to Ryan [ryanpenaphoto@gmail.com] or via Instagram [@memyself_andry]. A session is not considered confirmed until 50% of the session price has been received.

2. Accepted payment methods include Venmo, Cash App, Zelle, and Cash. Any remaining balance is due on the day of the session.

2. Cancellation & Rescheduling

1. Clients may reschedule their session with at least 24 hours' notice. Cancellations or reschedules made with less notice may result in forfeiture of the deposit.

2. If illness or an emergency arises, please communicate as soon as possible. Reasonable accommodations will be made at the photographer's discretion.

3. If the photographer must cancel or reschedule due to unforeseen circumstances, the client will be offered a new date or a full refund of any payments made.

 

3. Session Details

1. Clients are expected to arrive on time.

2. Late arrival may reduce session time and does not guarantee rescheduling or additional time.

 

4. Image Selection & Delivery

1. Proof images will be delivered via Google Drive approximately 3-5 days after the session.

2. Final edited images will be delivered within 1-2 weeks of image selection. All images are delivered as high-resolution digital files unless otherwise specified.

 

5. Retouching Policy

All final images include professional, natural retouching. This may include:

• Color correction

• Minor skin blemish removal

• Subtle adjustments for consistency and polish

Retouching does not include body reshaping, significant facial alteration, or changes that misrepresent age, features, or appearance. Additional retouching requests may incur an extra fee.

The photographer retains artistic discretion over final edits.

 

6. Copyright & Usage Rights

All images remain the copyrighted property of Ryan Martinez-Peña Photography.

Clients are granted a non-exclusive license to use their images for professional and personal promotional purposes, including but not limited to:

• Auditions and applications

• Personal websites

• Social media

• Press materials

• Résumés and artist bios

Images may not be sold, transferred, or used for commercial advertising or third-party products without written permission.

 

7. Photographer's Use of Images

1. Unless otherwise agreed in writing, the photographer may use selected images for portfolio, website, social media, and promotional purposes.

2. If a client prefers to opt out of this usage, they must notify the photographer in writing before the session.

 

8. Archiving & File Storage

1. Final images are archived for 1 year. After this period, the photographer cannot guarantee the file's availability.

2. Clients are encouraged to download and back up their files promptly upon delivery.

 

9. Client Responsibilities

Clients are responsible for:

• Wardrobe, grooming, and preparation

• Personal belongings brought to the session

• Communicating any concerns or preferences clearly

The photographer is not responsible for lost or damaged personal items.

 

10. Health & Safety

1. Clients agree to disclose any health concerns that may affect the session. The photographer is not liable for injuries unless caused by proven negligence.

2. If a client arrives visibly ill, the photographer reserves the right to reschedule the session. 

3. Please disclose any accommodations needed to the photographer in advance. Ex: need elevator, need wheelchair accessibility, sitting area etc...

 

11. Creative Control

1. The photographer retains creative control over lighting, posing, composition, and final image editing. While collaboration and feedback are welcome, specific outcomes or styles cannot be guaranteed.

 

12. Limitation of Liability

1. In the unlikely event of equipment failure, loss, or other circumstances beyond the photographer's control, liability is limited to the amount paid for the session.

 

13. Refund Policy

1. No refunds are issued once a session has taken place. Refunds prior to the session are governed by the cancellation policy outlined above.

 

14. Acceptance of Terms

1. By booking a session with Ryan Martinez-Peña Photography, the client confirms that they have read and agree to these Terms & Conditions.
